"CBD weed" is hemp flower. Federal law sets the limit at 0.3% delta-9 THC by dry weight. Hemp at or below that limit is not a controlled substance. Flower above it is cannabis under Schedule I. States add their own rules on top.

Legal sales channels
- Licensed cannabis dispensaries in states with medical or adult-use programs. They stock high-CBD flower, often labeled 10:1 or 20:1 CBD to THC. You need a state ID and, in medical-only states, a patient card.
- Licensed hemp farms and processors that sell direct. Most ship. Ask for the state hemp license number and a batch lab report.
- Hemp retailers and CBD shops with a state hemp permit. Walk-in sales, cash or card.
- Online hemp sellers. They ship to states where hemp flower is allowed. Read the shipping page before checkout.
Check these parameters first
- State law. Some states ban hemp flower or hemp-derived THC. Others cap total THC, not just delta-9.
- THC number. Hemp is 0.3% delta-9 THC or less. A label that lists delta-8 THC or THCA is a different product with different rules.
- Certificate of analysis (COA). This is a third-party lab report. It should list cannabinoid content, pesticides, heavy metals, mold, and residual solvents, plus the batch number and the lab name.
- Age. 21 at adult-use dispensaries. 18 or 21 for hemp, by state.
- Price per gram and milligrams of CBD per gram. Compare both. Flower weight and CBD content do not track each other.
Pitfalls
- No COA, or a COA with no batch number. You cannot match the report to the jar.
- "Legal in all 50 states" claims. State hemp laws differ. One state restricts products that a neighboring state allows.
- Mail order of high-THC cannabis. Mailing cannabis is a federal offense. Hemp shipments must stay at or under 0.3% and follow state rules.
- Health claims. The FDA has not approved CBD for food or as a dietary supplement. Epidiolex is the one approved CBD drug.
- Card declines. Many banks block hemp and cannabis merchants. Expect ACH, cash, or a payment app.
Before you order
Confirm three things: your state allows the product, the COA matches the batch, and the seller ships to your ZIP code. Keep the COA and the receipt. If a seller will not send a lab report before purchase, buy elsewhere.
