THCA is legal under federal law only when it comes from hemp. The 2018 Farm Bill defines hemp as Cannabis sativa L. with a delta-9 THC concentration of 0.3% or less on a dry weight basis. Federal rules count THCA toward that number, using a conversion factor of 0.877. A crop that tests above 0.3% total THC is marijuana under the Controlled Substances Act, and THCA in that crop is a Schedule I substance.

What the Controlled Substances Act Says

THCA, or tetrahydrocannabinolic acid, is not named in the Controlled Substances Act. The Schedule I entry at 21 CFR 1308.11(d)(31) covers tetrahydrocannabinols. DEA reads that term to include THCA. The same entry excludes THC found in hemp as defined in section 297A of the Agricultural Marketing Act of 1946.

How Total THC Is Measured

THCA is an acid. Heat removes the acid group and turns THCA into delta-9 THC. The molecular weights differ: THCA is 358.47 g/mol, delta-9 THC is 314.46 g/mol. The ratio is 0.877.

USDA hemp rules apply that ratio. Labs report total THC as delta-9 THC plus THCA multiplied by 0.877. Samples come from the flowering tops and are collected within 30 days before harvest. A flower with 0.2% delta-9 THC and 20% THCA fails the test. 20% THCA times 0.877 equals 17.54% THC.

What Happens When THCA Is Heated

A jar of THCA flower can test at 0.3% total THC and still deliver delta-9 THC when smoked or vaped. Decarboxylation starts near 220 F. Federal testing measures the plant before combustion, so the 0.3% limit applies to the raw material, not the smoke.

State Law Runs Alongside Federal Law

The 2018 Farm Bill does not stop states from banning hemp products. Texas SB 3, signed in 2025, ends retail hemp sales of products that contain THCA and other cannabinoids on September 1, 2025. Several other states restricted or banned THCA flower between 2023 and 2025. A product that is legal under federal law can still be illegal in the state where it ships.

Points to Check Before a Purchase

  1. Certificate of analysis from an accredited lab, with total THC at or under 0.3% dry weight.
  2. Harvest date and lot number on the COA.
  3. Delta-9 THC value listed apart from the THCA value.
  4. Shipping state, because state bans apply to delivery.
  5. License number for the grower or processor.

Open Questions

No federal court has ruled on whether isolated, high-purity THCA is hemp or a Schedule I drug. The Ninth Circuit held in Hemp Industries Association v. DEA (2004) that the CSA does not cover non-psychoactive hemp products with trace THC. AK Futures v. Boyd Street Distro (2022) upheld hemp-derived delta-8 under the Farm Bill. Neither case addresses THCA. DEA letters and statements in 2023 and 2024 point the other way, and no court has settled the conflict.

Congress has not amended the hemp definition since 2018. Rules can change.
