Hemp-derived delta-9 THC is the same molecule that gets you high in dispensary weed. What differs is where it came from and how it was processed. If the delta-9 was extracted from a cannabis plant that tested at or under 0.3% THC on a dry weight basis, or was made by converting CBD from that plant, sellers call it hemp-derived. That label matters for licensing and taxes. It does not change what the molecule does once it is in your body.
The 2018 Farm Bill pulled hemp out of the Controlled Substances Act. Hemp was defined as cannabis with no more than 0.3% delta-9 THC by dry weight. That threshold applies to the plant, and the math is where this market comes from. A five-gram gummy that is 0.3% delta-9 by weight holds about 15 mg of THC. A 30-gram chocolate bar at the same concentration holds roughly 90 mg. Nothing in the federal definition caps milligrams per serving, so producers build products around the percentage and state regulators answer by writing milligram limits instead.
Two routes show up on the market. One is direct extraction from hemp flower that came in under the cap, then concentration. The finished oil lands far above 0.3%, which is fine if your state measures compliance at the plant and not at the bottle. The other route starts with CBD, usually hemp CBD, and converts it to delta-9 using acid, heat, or a catalyst. That is the route regulators mean when they say synthetically derived. The DEA has said THC made by chemical conversion is not hemp, regardless of what the CBD started as. The FDA has not approved these cannabinoids as food ingredients and has warned about intoxicating hemp products sold without safety data.
Delta-8 THC is a different molecule, weaker per milligram, and mostly made by the same conversion route. Delta-9 is the one people know from dispensary flower and edibles. THCa is the acid form found in raw plant material. It is not intoxicating until heat converts it to delta-9, which is why a label that lists THCa separately still matters to your dose. If a package says 0.3% delta-9 and never mentions THCa or total THC, you cannot tell what you are getting.

Federal law sets a floor, not a ceiling. Some states treat hemp-derived delta-9 as regulated cannabis and require a dispensary. Some allow it with caps, often 5 mg per serving and 50 mg per package. Hemp-derived delta-9 is real THC with a legal label attached. It can be a solid product when a lab report backs the dose, and it can be an unregulated guess when nobody tests anything.
