Are Feminized Cannabis Seeds Legal in the US? A Buyer's Guide
Federally, feminized cannabis seeds are illegal if they exceed 0.3% THC. Hemp seeds are legal. State rules differ. Here is what buyers need to verify.
Feminized cannabis seeds with high CBD produce female plants with a CBD-dominant cannabinoid profile. Ratios in these lines run from 1:1 CBD to THC up to 20:1 or higher. Breeders list the female rate for feminized seed at 95 to 99 percent. High CBD is a marketing phrase, not a lab standard or a legal category. The number that matters is on the certificate of analysis (COA) for the batch.

A 1:1 seed carries genetics for equal parts THC and CBD. A 20:1 seed carries genetics for 20 parts CBD to 1 part THC. THC in a 20:1 line often lands near 0.5 to 1 percent, and CBD near 10 to 20 percent of dry flower weight. Phenotype spread inside one seed pack is wide. Two plants from the same pack can test at 1:1 and 8:1. Clones from a tested mother hold the ratio.
feminized vs autoflowering cannabis seeds
A female plant is treated with silver thiosulfate or colloidal silver. Silver ions block ethylene, the hormone that drives female flower development. The treated plant grows male flowers and sheds pollen with no Y chromosome. Pollen on a female flower yields seed with two X chromosomes. Those seeds grow female plants. Self-pollinated lines are labeled S1. Crosses between two females are labeled F1 or S1 x S1, based on the breeder method.
US federal law sets hemp at 0.3 percent delta-9 THC or less on a dry weight basis. Cannabis above that line is marijuana under federal law. The line applies to the harvested plant, not the seed. A seed holds no THC. State rules on seed possession, sale, and germination differ, and some states bar germination of cannabis seed without a hemp license. Check state law before you buy.
Many sellers label seed as a souvenir or novelty item. That label does not change state law or germination rules.
Photoperiod CBD lines flower in 8 to 11 weeks indoors. Autoflowering CBD seeds finish 60 to 90 days from sprout. CBD sits in trichomes on the flower, so harvest timing and the dry and cure stages change the final test result. Send a dried flower sample to a lab for HPLC or GC analysis to confirm the ratio. Hemp growers under USDA rules sample within 30 days before harvest and test delta-9 THC on a dry weight basis.
Seed keeps about one to two years at room temperature. At 4 to 8 C in a dark, dry container, seed keeps longer. Moisture is the main risk. A silica pack in a sealed jar helps.
