Cannabis Rescheduling Update: Everything You Need to Know
Stay informed with the latest update on the rescheduling of cannabis and understand its implications for purchasing THC products online.
If you want THC shipped to your door without a state medical card, hemp-derived products cover the most states. The 2018 Farm Bill defines hemp as cannabis with 0.3 percent delta-9 THC or less on a dry weight basis. Products under that limit are treated as hemp, not marijuana, under federal law. Some states ban delta-8 and other hemp-derived cannabinoids. Check state rules before ordering.
Two federal changes are in play. They are not the same thing.

Rescheduling moves cannabis to a different schedule under the Controlled Substances Act. The DEA proposed moving cannabis from Schedule I to Schedule III in May 2024. Hearings started in January 2025. No final rule exists.
cannabis rescheduling impact on legality
Schedule III does not legalize cannabis. Recreational sales stay illegal under federal law. No federal medical program starts. Three things change if the rule is finalized:
when will cannabis be rescheduled
Rescheduling does not open interstate shipping. It does not create federal retail. It does not change the 0.3 percent hemp limit.
Legalization means Congress removes cannabis from the Controlled Substances Act. Bills have been filed. The MORE Act passed the House in 2020 and 2022. It did not get a Senate vote. No descheduling bill has passed both chambers.
Legalization would do more than Schedule III:
State law still controls retail age limits, possession caps, and store licensing. Federal legalization would not override state bans.
Hemp-derived THC wins today because it ships. Rescheduling helps license holders with taxes and research. It does not help a buyer in a state with no dispensary. Legalization would help most, but it needs an act of Congress and none has passed.
Buy from sellers that post batch lab results. Look for delta-9 THC percentage, total THC, and the testing lab name. Hemp flower can test above 0.3 percent delta-9 after decarboxylation, and that matters for legal risk.
